CMRRA – Legal Counsel – Licensing (CA)

The Legal and Business Affairs department is responsible for the organisation and implementation of general business and legal matters within the company.

Licensing Counsel will be part of the Management team at CMRRA and will interact with various departments within the company. Counsel will primarily assist the VP, Legal and Business Affairs in matters as they arise, largely in contract negotiations and drafting.

Counsel will also assist in matters related to the Copyright Board of Canada, legal and policy analysis, and implementation of tariffs and/or agreements. Additionally, Counsel will act as an intermediary with the Operations team on the requirements and implementation of data exchanges with licensees. Counsel may also assist the Executive team with larger strategic considerations and internal policy development as may arise.

Key Responsibilities
  • Act as primary liaison between CMRRA and licensees
  • Negotiate, draft, and manage execution of licensing agreements
  • Oversee implementation of licensing agreement by working closely with operations team on data exchange requirements
  • Law and policy research, analysis and advocacy (primarily copyright law)
  • Coordinate and work with outside counsel on legal and business matters concerning the Company
  • Work closely with Enforcement Counsel to enforce terms of license agreements and tariffs
  • Field general inquiries from staff and public
  • Make recommendations to Management on questions of law, regulations and rulings affecting the operations of the Company
  • Contribute to strategic and business development of the Company
  • Assist in matters related to the Copyright Board of Canada, including advocacy, tariff drafting, preparation for and involvement in hearings
  • Formal reporting on case/project status to Management and external parties as required • Supervise Business Affairs licensing staff
Qualifications, Experience and Skills
  • Licensed lawyer in good standing with the Law Society of Upper Canada (with a keen interest or background in copyright law)
  • 3 to 5 years relevant experience
  • Strong oral and written communication skills
  • Sound analytical thinking, planning, prioritisation, and execution skills
  • Some experience and/or familiarity with the music industry, film and television industry or technology industry an asset
  • Ability to work independently
  • High level of integrity, confidentiality, and accountability
  • Strategic thinker with disposition towards results
  • Desire to learn and develop knowledge related to clients and licensees’ business, with a focus on new media and technologies
  • Strong working knowledge of MS Excel and mathematical skills
